
High Court judge Hanipah Farikullah fixed the date after hearing the preliminary objection by senior federal counsel Amarjeet Singh, representing the Malaysian Government and NSC, saying that the High Court had no jurisdiction to decide on Anwar’s suit.
The proceeding in chambers was also attended by lawyers N Surendran and Latheefa Koya, who were acting on behalf of Anwar.
“The suit questions the power of Parliament to formulate laws, while the power and discretion to hear the suit lie with the Federal Court,” Amarjeet told reporters here.
He said the court had also today ordered both parties to file a written submission.
On Aug 2, Anwar, the former Opposition leader, filed a suit to defer the implementation of the National Security Council Act on grounds that it is unconstitutional.
The originating summons was filed through his lawyers N Surendran, R Sivarasa and Latheefa Koya, naming the Malaysian Government and NSC as respondents.
