Govt to strike out lawsuit by firm on date imports

KUALA LUMPUR:
The government will be moving to strike out the lawsuit by dates importer and distributor, Asia Kitchen Industries Sdn Bhd, on claims that it was “prejudiced” by the Goods and Services Tax (GST).

Senior federal counsel Farah Ezlin Yusop Khan told reporters, after case management on Wednesday, that the government intends to strike out the lawsuit.

“However, we will file the application after we receive the amended statement of claim from Asia Kitchen,” she said.

Lawyer Abu Backer Sidek for Asia Kitchen said the registrar fixed August 26 for another case management for the company to amend its statement.

On June 17, the company sued the Customs Department and government. It claimed the GST had impacted the market for dates.

It alleged that there was “double standard” by the government towards Muslims on food items during their festive season. Other food items, during other festive seasons, were zero rated, it claimed.

Asia Kitchen also claimed that the government had acted unfairly and betrayed the people on the cost of living issue. It referred to the rising cost of living and charged that the people were suffering as a result.
