A three-man bench comprising Justices Wira Mohtarudin Baki, Kamardin Hashim and Abdul Karim Abdul Jalil allowed ASP Badrol Hisham Othman’s to be acquitted and discharged on the charges.
This was after deputy public prosecutor Wan Shaharuddin Wan Ladin told the court that the prosecution did not intend to pursue the charges against him after the complainant, the woman’s husband, withdrew the police report against Badrol Hisham in the interest and good name of the family.
On June 2, last year, the Sessions Court gave Badrol Hisham a discharge not amounting to an acquittal after the woman’s husband told the court that he was withdrawing the police report against him (Badrol Hisham) in the interest of his family.
A discharge not amounting to an acquittal means he was not fully acquitted and could be charged with the offence again.
On Jan 14, this year, Badrol Hisham lost his appeal at the High Court to reverse the Sessions Court’s order.
Badrol Hisham, 45, had allegedly enticed the 44-year-old woman, who is the wife of a teacher aged 49, with the intention of having illicit sex with her at a hotel in Jalan Sungai Besi here on March 6, April 29 and Oct 13, 2014.
His lawyer, Muhammad Nor Izzat Nordin, said since the prosecution did not intend to pursue the charges against his client, he urged the court to acquit and discharge him.
Badrol Hisham is attached to the General Operations Force in Lahad Datu, Sabah.
