Kenny Chua Boon Meng pleaded guilty to the charge against him under Section 415 of the Penal Code for allegedly cheating Muhamad Faizal Sulaiman, by inducing him to give him RM20,000, in return for not taking further action on investigation papers, which he knew were non-existent.
Sessions Court judge Amran Jantan sentenced Chua to three months jail from the date of his arrest (April 7) and fined him RM3,000 after he pleaded guilty.
“A deterrent sentence must be imposed as this is a matter of public interest,” said Judge Amran. “If he failed to pay the fine, he will have to serve three months of jail.”
Chua was unrepresented while DPP Heikal Ismail appeared for MACC.
According to the facts of the case, Chua called Faizal on the evening of April 6 and told him that he was being investigated.
Faizal then met him at night. Chua allegedly asked him for RM20,000 to close the file on the investigation papers.
On April 7, Chua allegedly asked Faizal to meet him at the Bangi toll and surrender the money to him. However, he then reportedly changed the location to the Fire Department Station in Bangi.
According to the facts of the case, Faizal then entered Chua’s car parked at the station and handed him an envelope containing RM20,000 cash.
Chua was arrested after Faizal left his car.
