Pua: Probe PAC report from a criminal aspect

PAC member wants Bank Negara, police and MACC to look into the report for existence of any criminal misconduct and prefer the necessary charges.

KUALA LUMPUR: The responsibility is now on the relevant enforcement authorities to investigate if any criminal misconduct has occurred in the management of 1MDB.

DAP lawmaker Tony Pua, who is also a member of the Public Accounts Committee (PAC), said just because the panel’s report had not mentioned any criminal wrongdoing, that did not mean it did not happen.

“The PAC report has to be investigated from a criminal aspect.

“So we hope all relevant authorities, including Bank Negara Malaysia (BNM), the police and the Malaysian Anti-Corruption Commission, will look into the report we have prepared.

“We also hope that they will look for the existence of any criminal misconduct and prefer the necessary charges,” he told a press conference at the DAP headquarters here today.

He also said while PAC welcomed the resignation of 1MDB’s board of directors, that should not be the end of it.

“The state investment firm’s advisory board must also heed the recommendations made by the parliamentary panel and dissolve itself,” Pua added.

“How come Najib has not addressed this?”

According to Pua, the PAC had also recommended for Article 117 of 1MDB’s Memorandum and Articles of Association to be repealed.

This article required the explicit written endorsement of the prime minister for every single substantial transaction carried out by the firm.

“Worse still, it explicitly forbids the appointment of any Finance Ministry official in the company, which could have acted as an additional check and balance on the rogue management.

“The lack of oversight at the level of the Finance Ministry, as testified by Treasury Secretary-General Irwan Serigar to the PAC, only further increases the culpability of the prime minister in this entire scandal.”

Pua, however, expressed his lack of confidence in the government, saying that he had an inkling that the panel’s recommendations would be ignored.

“Based on past experiences, I have a feeling they will disregard the PAC’s report.

“So we will continue to shout and scream.”
