Magistrate Mohd Rehan Mohd Aris fixed the date to make a decision after hearing submission from the duo’s lawyer Eric Paulsen.
He argued that lower courts have no jurisdiction to hear their defence as it involved constitutional matters. “They are exercising their rights on freedom of assembly.”
“The two of them are just performing their duties as citizens under the Constitution, including taking to the streets to protest,” he added.
Adam and Fariz were charged along with activist Rozan Azen Mat Rasip and Assemblymen Chang Lih Kang and Lee Chean Chung on September 8, 2015 for allegedly joining the #KitaLawan rallies between February 21 and March 28.
