He told the Magistrate’s Court on Tuesday that he was on duty as a videographer during the rally in March last year to record it.
He told lawyer Eric Paulsen that in the video he recorded, he agreed that a big man, not in uniform, was trying to pull down the banner.
“Yes, they (rally goers) asked him who he was and asked him to show his (authority) card but he did not show anything,” said Saiful, who is with the Dang Wangi police district photo department.
Saiful agreed with Paulsen that “because of this man, who was clad in black shirt, chaos erupted during the rally”.
Paulsen was representing Chang Lih Kang, Tan Kar Hing, and three others, namely Chee Chu Sang, Yong Ming Chong, and Gan Zhi Mou ,who were charged last year with allegedly obstructing DBKL officers from carrying out their duties.
They were arrested at the #KitaLawan assembly.
They were charged under Section 186 of the Penal Code, read together with Section 34, which carries a jail term of not more than two years and a maximum fine of RM10,000 or both if convicted.
Chee was also slapped with another charge of using criminal violence, under Section 353, on a DBKL officer carrying out his duties.
He can be jailed up to two years, fined or both.
During re-examination by deputy public prosecutor Suhaimi Ibrahim, Saiful said his job during the rally was only taking footage of the rally.
He added that he did not see other things happening during the rally as he was recording. He said that he was unaware what was taking place, if anything, beyond his lens.
The hearing continues on May 17 before Magistrate Nur Aminahtul Mardiah Md Nor.
