
The High Court rejected the man’s claim of consensual sex, and held that the woman was in a state of near-unconsciousness at the time and clearly lacked the capacity to consent to sex.
Jasper Lee Loong Kuan, 37, who was found guilty on Feb 10, faces 14½ years’ jail and 12 strokes of the cane, the Straits Times reported. He said he would appeal and was granted S$100,000 bail.
The court was told that Lee, managing director of his own company, was a client of the firm where the victim was a customer service officer. Finding that they shared the same birthday, they agreed to celebrate with dinner at a mall on Sept 15, 2021. It was the first time they had met in person.
After finishing two bottles of red wine, the woman told Lee that she wanted to go home as she was feeling quite drunk, and dashcam audio showed that the woman had vomited and was slurring while Lee drove her home and helped her to her home.
The victim testified that she was drifting in and out of consciousness on her bed, and at one point, she realised that she was naked and Lee was on top of her.
She tried to push him away but was too weak to do so, and fell unconscious again, the court was told.
Video footage show Lee leaving her flat at about 9.50pm, at about the time she called the police and also sent a message to Lee, saying: “You are too much.”
Police who answered her call found her naked and crouched behind the door when they arrived, the court was told.
