
TH’s lawyer Akberdin Abdul Kader said Hidayat Razali has also been given 24 hours to delete the clip published on social media.
According to court documents, Hidayat had on Sept 17 claimed in a video that many depositors were withdrawing savings kept with the pilgrim fund.
In a supporting affidavit, Tabung Haji’s legal head, Suhaimi Ismail, denied the claim, adding that the allegation had misled depositors by creating a negative impression of the fund’s financial position.
Suhaimi also said the allegation had damaged TH’s reputation as a renowned statutory body.
The video’s contents, he added, gave the impression that TH was experiencing a liquidity crisis and had acted unprofessionally in discharging its fiduciary duties.
TH also contends that the allegations were malicious and intended as a character assassination, as Hidayat had not sought its explanation.
The video, TH added, had drawn negative comments about the pilgrim fund.
TH is seeking general damages, which includes aggravated and exemplary damages.
