PETALING JAYA:
The Klang High Court has sentenced a mechanic to seven years’ imprisonment for causing the death of his girlfriend three years ago.

Justice Norliza Othman handed down the sentence to 22-year-old Amirul Amin Amiruddin last month after he pleaded guilty to a reduced charge under Section 304(b) of the Penal Code of culpable homicide not amounting to murder.

The grounds of judgement were released today.

Amirul was initially charged with murdering his girlfriend, Nurul Shahira Abdullah, at a house in Kampung Sri Pandan in Klang on Aug 24, 2022.

However, the court ruled that the prosecution failed to prove the elements of the murder charge.

During the trial, the court heard testimony from Amirul’s friend, who received a video call from him on that day in which he “confessed” to covering Shahira’s face with a pillow.

He also showed the friend Shahira’s remains covered with a blanket, causing the friend to panic and end the call.

The investigating officer testified that Amirul told the police he was asked to sign an “undertaking” letter by Shahira, promising that he would not leave her or end their relationship.

Amirul reportedly refused to sign, which prompted Shahira to become aggressive and attack him with a knife.

He told the police he acted in self-defence to stop Shahira from attacking him and had no intention of killing her.

During cross-examination, the investigating officer, Syed Robart Syed Zain, acknowledged that this was Amirul’s version of events, but the “undertaking” letter was not produced in court as evidence.

Justice Norliza said, “As the investigating officer, the witness needs to conduct the probe in a fair manner.”

The judge described the incident between Amirul and Shahira as an unfortunate event and noted that Amirul had fully cooperated with the police during the investigation, even leading them to the crime scene.

“The accused is to serve his sentence from the date of his arrest on Aug 24, 2022,” she added.
