Justice Bupindar Singh ordered Wong Mun Fai and Tan Chun How, both 33, to serve their sentence from the date of their arrest on Nov 15, 2018, Harian Metro reported.
Wong and Tan pleaded guilty to an alternative charge under Section 304(a) of the Penal Code to jointly committing an act leading to the death of Heng Wei Yong, who was 21 at the time.
They committed the offence at the entrance of an oil palm plantation on Jalan Kampung Bankar in Teluk Intan, Hilir Perak, between 12.05am and 12.30am on Nov 15, 2018.
According to the facts of the case, a statement by the 29th prosecution witness, who was also arrested following the incident, was determined to have shown that Wong and Tan were the last individuals to be seen with the victim.
The case facts revealed that there was more than one stab wound on Heng’s body, and a forensic pathologist had determined the stab wounds to be the cause of death, not the burning.
They also stated that the body was burnt to prevent recognition of the victim.
“Based on all the statements presented by the prosecution, it is clear that the two accused committed an act that caused the death of the victim,” the case facts read.
Deputy public prosecutor Nasrul Hadi Abdul Ghani led the prosecution. Wong was represented by lawyers Naran Singh and Amrick Singh Sandu, while Tan was represented by V Santhiran.
