
A three-member bench, chaired by Justice Zaini Mazlan, also ordered the accused, Ahmad Radzi Roslan, to be given two strokes of the cane.
Zaini said the sessions court and the High Court did not err in law and fact in finding that Radzi, 30, had committed the crime at the girl’s home in Ipoh seven years ago.
“The girl was a credible witness and her testimony was corroborated by medical evidence,” said Zaini, who sat with Justices Azmi Ariffin and Hayatul Akmal Abdul Aziz.
He said the girl and her mother’s evidence were also admissible, though there were some inconsistencies in their evidence.
“We find the inconsistencies were not material enough to dent the prosecution’s case.”
Zaini said the defence witnesses also failed to cast any doubt on the prosecution’s case.
“The conviction is sound and the sentence imposed is not excessive,” he said, adding that the bench was issuing a warrant of committal for Radzi to begin his jail term today.
The court also ordered the return of the RM15,000 bail sum to Radzi, who remained calm as the ruling was delivered. However, his mother was seen in tears in court.
Radzi was 23 years old when he committed the offence at the home of the girl’s parents in Ipoh at about 7am on June 1, 2018.
After a trial, the sessions court in 2023 sentenced him to 10 years’ imprisonment and ordered him to be whipped two times.
The trial court also ordered Radzi to be put under police supervision for a year after serving the jail term.
Lawyers Syahrul Nizam Rabi and Izzat Fakhari Halimi appeared for Radzi, while deputy public prosecutor Solehah Noratikah Ismail acted for the prosecution.
