
Judge Rosli Ahmad ruled that the defence put forward by Nur Fikri Fadzilee, 28, and Fazly Hambali, 39, was unreasonable and not credible.
He also ruled that they had failed to rebut the presumption under Section 50(3) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 on a balance of probabilities.
Rosli ordered their jail term to begin immediately and said they would have to serve an additional two months if they failed to pay the fine.
According to the charge sheet, Fikri, who held the rank of lance corporal, and Fazly, a corporal, received RM800 in cash from a junior officer suspected of committing khalwat with a woman in a car near a petrol station at Presint 8, Putrajaya, at about 12.30am on Oct 1, 2020.
Deputy public prosecutors Fadhly Zamry and Hanafi Firdhaus Abd Latif appeared for the prosecution, while Fikri was represented by lawyer Afiq Audy Basharudin. Fazly was unrepresented.
