Babysitter charged with negligence, causing death

The 24-year-old woman is accused of failing to ensure proper supervision and care at a childcare centre in Wangsa Maju.

KUALA LUMPUR:
A babysitter at a childcare centre has pleaded not guilty in the sessions court here to being negligent and causing the death of a seven-month-old baby under her care.

Nur Fatihah Rahim, 24, was charged under Section 33(1)(a) of the Child Act 2001 with failing to ensure the baby’s proper supervision and care, leading to the child’s death.

The incident allegedly took place at a childcare centre in Wangsa Maju here at about 11am on May 26.

If convicted, she faces up to five years’ imprisonment, a fine of up to RM20,000, or both.

Deputy public prosecutor Nidzuwan Latip objected to bail, citing the seriousness of the offence and saying the accused posed a flight risk.

Fatihah, who was unrepresented, appealed for a minimal bail amount, saying she came from a poor family and was supporting her ailing father.

She also told the court she was due to get married later this year.

Fatihah, who sobbed while making her request to the court, repeatedly looked towards her family members in the public gallery for guidance.

Judge Siti Shakirah Mohtarudin fixed bail at RM20,000 with one surety and set Sept 29 for mention.

As the police prepared to escort her to the lock-up pending bail payment, Fatihah wailed and repeatedly called for her mother, who tried to console her.

The family failed to post bail.

Lawyers Fithril Hakim Jalil and Abi Mursyidin Awal held a watching brief for the victim’s family.
