Man jailed 30 years, whipped for trafficking in 3.8kg of shabu

The Court of Appeal rules that information provided by Lim Wei Jie leading to the discovery of the drugs was admissible as evidence.

The Court of Appeal has refused to overturn Lim Wei Jie’s conviction and sentence for trafficking in 3,832g of shabu four years ago.

The Court of Appeal has upheld the 30-year prison sentence and whipping handed down to a man convicted of trafficking 3.8kg of shabu, which he led police to himself four years ago.

A three-member bench chaired by Justice Che Ruzima Ghazali dismissed Lim Wei Jie’s appeal against his conviction and sentence, holding that the trial judge had not erred either in law or fact to justify appellate intervention.

Che Ruzima, who sat with Justices Azmi Ariffin and Choo Kah Sing, said the information provided by Wei Jie which led to the discovery of the drugs was admissible as evidence.

Wei Jie, 34, committed the offence at a road shoulder near Bangunan M Avenue in Jalan Segambut, Kuala Lumpur, at about 3.30pm on Nov 29, 2021.

He was sentenced by the High Court on Dec 19, 2023 to jail and 12 strokes of the rotan after being found guilty of the charge.

The facts of the case revealed that a police raiding party led by officer Andrew Lim had intercepted a car belonging to Wei Jie’s mother and driven by the accused at the crime scene.

Claiming to be a parcel delivery worker, Wei Jie led police to the discovery of a labelled box containing the drugs under the vehicle’s bonnet.

The information was reduced to writing in the police report which was produced in court.

Chemist Nur Ikadewi Sarimin said her analysis revealed the drugs to be methamphetamine, or shabu, weighing 3,832g.

Andrew also testified that Wei Jie’s mobile phone, which was seized by the police, did not have the Lalamove or Telegram apps installed to indicate that he was in the goods delivery business at the time the crime was committed.

Investigating officer Ridhuwan Zaini testified at trial that Wei Jie had, in his cautioned statement, referred to two individuals but that they were not investigated as the information provided was sketchy.

Lawyer Haziq Aziz appeared for Wei Jie while deputy public prosecutor Ng Siew Wee represented the prosecution.
