
In a statement, the department said the stop-work notice was effective immediately for all works at the site pending an investigation.
“A formal directive has been issued mandating the implementation of safe work procedures and risk assessments for septic tank operations, including the appointment of qualified personnel such as a certified gas tester,” it said.
Yesterday, it was reported that the three workers who died were believed to have been exposed to hazardous gases – hydrogen sulphide and carbon monoxide – while they were trapped in the sewer hole.
Perak fire and rescue department director Sayani Saidon said that a hazardous materials unit team had been deployed to conduct tests at the site.
Perak DOSH today said that an inspection of the site had found no ventilation system in place for the confined space and no documented safe work procedures as required under the Industry Code of Practice for Working in Confined Spaces 2010.
It also said the resort had failed to notify DOSH of the project via the required form.
It said that concrete work on the septic tank structure was completed about two weeks ago, after which the sewer hole was fully sealed.
It said that on Sunday morning, the first victim opened the sealed hole and entered the septic tank, where he lost consciousness. The second victim descended to assist him but also passed out.
“The third victim, attempting to help, suffered the same fate. The first and second victims died at the scene, while the third was pronounced dead at the Lenggong health clinic. One individual remains in critical condition,” it added.
The department said it would continue its investigation by collecting relevant documents and recording witness statements.
“Legal action will be taken against any party found to have violated the Occupational Safety and Health Act 1994, which carries a maximum penalty of RM500,000 for employers found guilty,” it said.
Perak fire and rescue department assistant director of operations Sabarodzi Nor Ahmad previously said that two of the victims, local men aged 29 and 37, died at the scene, while an Indonesian national succumbed to his injuries at the hospital.
The workers were reportedly performing cleaning duties at the resort site when they became trapped, along with four others.
