Hambali seeks depositions by 2 Malaysians for hearing

Lawyers want to determine if Nazir Lep and Farik Amin were influenced by the prospect of being sent back to Malaysia.

Lawyers representing Indonesian terror suspect Nurjaman Encep or Hambali are seeking depositions by two Malaysians to use as evidence in a forthcoming hearing.

The lawyers have also moved to compel the discovery of the communication between the two, Nazir Lep and Farik Amin, and the US and Malaysian governments.

They had been held at the Guantanamo Bay detention centre since 2006 but were eventually repatriated to Kuala Lumpur last December after they pleaded guilty, to serve the remainder of a five-year sentence.

Hambali’s lawyers said they seek to establish if the US government’s first priority was to make the pair provide truthful testimony or was it mainly to simply implicate Hambali, who is alleged to be the mastermind of the Bali bombing.

Nazir, 47, and Farik, 48, made their depositions before they changed their plea to guilty.

Both men admitted to conspiring with Hambali to commit the bombings which killed 202 people. They were sentenced to 23 years in prison. However, under a pre-trial agreement, they could be released after five years and repatriated to a third country.

Hambali’s lawyers said the defence could decide whether to obtain the presence of the two witnesses to provide live or remote live testimony at trial.

The trial is set to begin next month.
