Court forfeits Four Seasons condo unit, cash linked to ‘fugitive’ businessman

The Kuala Lumpur High Court granted the Securities Commission application to forfeit a luxury condo unit owned by Havana Bayview Sdn Bhd and over RM445,000 in a personal fixed deposit account.

The Kuala Lumpur High Court has granted the Securities Commission Malaysia’s (SC) application to forfeit a company’s luxury condominium unit and over RM445,000 belonging to an alleged fugitive businessman.

Justice Azhar Abdul Hamid, however, granted Havana Bayview Sdn Bhd and Wong Shee Kai, a director and substantial shareholder of the company, an interim stay of the order pending the filing of a formal stay application.

The SC said it had applied to forfeit the Four Seasons Place condo unit on Jalan Ampang in downtown KL and some RM445,039 held in Wong’s personal fixed deposit account.

The commission said the application was connected to RM56 million in proceeds raised by Bright Packaging Industry Bhd through corporate exercises between October 2013 and July 2014 allegedly siphoned out of the company.

A portion of the RM56 million was used to purchase the luxury condo unit, it said in a statement.

“The RM445,039.28 sum was interest generated from a portion of the proceeds that were placed into Wong’s fixed deposit account,” it added.

The SC had sued Wong, Teh Sew Wan and Wong SK Holdings Sdn Bhd in May 2020 for alleged securities fraud offences under the Capital Markets and Services Act 2007.

The commission is also trying to locate Wong in connection with alleged violations of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (Amla).

Wong’s lawyers previously denied claims that their client was a fugitive, after the Federal Court dismissed his application to attend the hearing of SC’s civil suit against him remotely.

They said Wong has never been charged in court and is not wanted by Malaysian authorities for any substantive offence but for his alleged failure to assist the SC in its investigations.
