Suhakam to stick by due process, after officer threatens suit

The human rights commission, Suhakam has sidestepped a staff member’s threat to drag the commission to court over his allegedly unjust demotion.

In a statement today, Suhakam said it would ensure that due process was followed and that all its actions were in line with legal and procedural guidelines.

“As this matter involves confidential issues of the employee’s conduct and record, Suhakam is committed to safeguarding the integrity of its processes and will not comment further as the due process according to our rules and regulations are ongoing.

“The employee will be given the opportunity to exercise his rights. Despite the public statement, Suhakam would not be hindered or detracted from our duty to ensure compliance with all internal regulations, managerial prerogatives and within the ambit of laws relating to industrial relations,” it said.

Earlier today, Suhakam officer Alfonso Min told FMT he was seeking a judicial review by the High Court of Suhakam’s decision to demote him from Grade 48 to 41.

He alleged the demotion was carried out without due process last August, allegedly for underperformance, resulting in a salary reduction.

Min said he had consistently fulfilled his duties responsibly and efficiently. He has been with Suhakam since 2013 and is based in Kota Kinabalu.

His claim against Suhakam comes in the wake of complaints over alleged salary increments granted to three Suhakam deputy secretaries, the alleged use of different performance assessment systems, and the exclusion of staff from the new public service remuneration system.
