Trader jailed 10 years for assaulting pregnant wife, leaving her in coma

The Johor Bahru sessions court heard that the wife delivered a boy through cesarean section while still unconscious.

The sessions court here today sentenced a trader to 10 years in prison for assaulting his wife, who was 10 weeks’ pregnant at the time, leaving her in a coma three years ago.

Judge Fatimah Zahari handed down the sentence to Rosmaini Abd Raof, 41, after the court found the prosecution’s case to be proven beyond reasonable doubt.

Rosmaini was charged on June 17, 2021 with repeatedly assaulting his third wife, Jahidah Nordin @ Sylvester, 46, and stomping on the back of her hand.

According to the charge sheet, he committed the offence at an apartment at Kampung Aman in Larkin at 6am on May 4, 2021.

He was charged under Section 325 of the Penal Code, which carries a maximum of seven years in prison and a fine, in conjunction with Section 326A, which doubles the maximum prison term for such offences, upon conviction.

Jahidah, a public servant, delivered a boy through caesarean section while still in a coma on Nov 30, 2021.

The Seremban shariah lower court had granted the fasakh (dissolution of marriage) application filed by Jahidah’s family on Feb 1, 2023, on March 15 the same year.

The final ruling on Nov 3 had to be postponed after Rosmaini failed to attend court, citing hospitalisation due to ill health.

The court also dismissed the application by his lawyer, Kamal Hisham Ja’afar, to stay the execution of the sentence pending an appeal to the High Court.

Deputy public prosecutor Siti Fatimah Mamu appeared for the prosecution, while Rosmaini was represented by Kamal Hisham, Salleh Togimin, and Aina Kamilah Zalizan.

Hazeem Norizan and Syufri A Samad, the watching brief lawyers representing Jahidah’s family, were also present during today’s proceedings.

Outside the court, Jahidah’s sister, Fauziah, 43, expressed her relief and gratitude that her case has been settled.

“From now on, we will continue with our lives as usual and care for Kak Jahidah. We hope she recovers quickly and that her child grows up well,” she said.
