Court upholds acquittal of police officer in drug-related case

The Seremban High Court cites insufficient grounds to overturn the acquittal of Roslan Sam.

The Seremban High Court today upheld a ruling by the magistrates’ court to acquit a police inspector from a drug-related charge filed four years ago.

Justice Rohani Ismail dismissed the prosecution’s appeal against the Nov 6, 2023 ruling, citing insufficient grounds to overturn the acquittal of Roslan Sam, Bernama reported.

The prosecution was represented by deputy public prosecutor Nik Nur ‘Aqilah Syarfa Nik Zaidi, while Roslan was represented by lawyers Haresh Mahadevan and Ramzani Idris.

Roslan, 44, was initially charged with using and administering dangerous drugs, including ketamine, amphetamine, methamphetamine, methylenedioxyamphetamine and methylenedioxy methamphetamine.

He was alleged to have committed the offence at the Seremban police headquarters’ narcotics office at 3am on Sept 27, 2020.

He was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952, which carries a fine of up to RM5,000 or a maximum of two years’ imprisonment, upon conviction.

The magistrates’ court previously acquitted Roslan after ruling that the prosecution had failed to establish its case beyond a reasonable doubt.
