
Magistrate Amalina Basirah Top ordered Imran Othman, 32, to serve his prison sentence from the date of his arrest on Sept 25.
On the first charge, the man was accused of breaking into the home of his ex-girlfriend’s father in Taman Melawati at 1.30pm on Sept 18, reported Utusan Malaysia.
The charge was framed under Section 448 of the Penal Code for house trespass, which carries a punishment of up to three years’ imprisonment or a fine of up to RM5,000, or both, upon conviction.
On the second count, Imran was accused of breaking the doorknob and glass door of the same house, causing damages amounting to RM41,580 at the same location and time.
The second charge was framed under Section 427 of the Penal Code, punishable with imprisonment not less than one year but not exceeding five years, or a fine, or both, if found guilty.
He was also accused of threatening to beat up the woman, with the charge framed under Section 14 of the Minor Offences Act 1995, which carries a maximum fine of RM100 upon conviction.
Based on the facts of the case, the 24-year-old woman heard stones being thrown at her window.
Upon checking, she saw that her ex-boyfriend was in the house compound and breaking the glass door using a metal dumbbell while yelling her name.
The woman then hid in her bathroom and called 999 while the accused tried to break into her bedroom with the dumbbell. Police arrived not long after.
Deputy public prosecutor Norhidayah Abdullah Sani asked the court for a heavier punishment to reflect the gravity of the accused’s actions, which had traumatised the victim.
Lawyer Nadi Irwanita Rosli of the National Legal Aid Foundation, appearing for Imran, asked the court for a lighter sentence as the accused had pleaded guilty and stated that the incident was due to a misunderstanding with the victim.
