
The woman, who is the prosecution’s ninth witness, said if their relationship had been consensual, she would have complied with Lew’s request to view her body during a video call.
During cross-examination by Lew’s counsel, Ram Singh, the complainant said that she refused Lew’s request and decided to record the video call.
Although she had not initially intended to record it, she said she did not regret doing so as the video turned out to be useful evidence to secure justice over Lew’s alleged sexual harassment.
Ram: Why would you record the video without Ebit Lew’s consent or knowledge?
Witness: I didn’t know at the time, but it was my instinct to record and that was the first time I recorded it. If you ask me today, it was good that I recorded (the video).
Meanwhile, the 10th prosecution witness, police photographer Shahrul Sanudin, 38, said that he took 35 photographs of a house in Shah Alam on Aug 19, 2021, along with images of a mobile phone.
In the examination-in-chief by deputy public prosecutor Analia Kamaruddin, Shahrul said the photos included the house’s exterior, house number, electricity bill, living room, bedhead, bolster, bathroom, and the front and back of a mobile phone.
The 11th prosecution witness, police photographer Husni Haris Ramli@Fauzi, 34, testified that he also took four photos of the front and back of the mobile phone, including its SIM and memory cards.
Husni confirmed that he transferred the images to two compact discs (CDs), accompanied by notes related to the case report in Tenom.
Lew, 38, is facing 11 charges of outraging the modesty of the woman, in her 40s, by sending lewd messages and photographs to her via WhatsApp between March and June 2021.
He was charged under Section 509 of the Penal Code and could face up to five years in jail, a fine, or both if found guilty.
The trial will resume tomorrow.
