
Deputy public prosecutor Rullizah Abdul Majid told judge Norina Zainol Abidin today the prosecution has handed a copy of the footage over to Avitan’s lawyer on condition that it not be disseminated to any other party, reported Harian Metro.
“The footage has already been analysed by forensic experts and will be used as evidence,” Rullizah said.
Avitan’s lawyer, Jeffrey Ooi, did not object, but requested that the defence be allowed to engage experts to analyse the footage.
The prosecution also applied for the trial to be rescheduled as DPP Mustafa P Kunyalam, a member of the prosecution team, , is also involved in Najib Razak’s 1MDB case, which overlaps with Avitan’s trial dates.
Avitan’s trial was previously set to be heard on Sept 30, Oct 1 to 3 and Oct 7 to 11.
“The prosecution requests that the case be fixed for mention on Sept 30 to fix the new trial dates,” said Rullizah, adding that the defence had no objections to the request.
Norina fixed the case for mention on Sept 30 to set the new trial dates.
In April, Avitan, 38, was slapped with a charge under Section 7(1) of the Firearms (Increased Penalties) Act 1971 for trafficking in six guns, as well as one charge under Section 8 of the Arms Act 1960 for possessing 200 bullets.
He faces a jail term of between 30 and 40 years and a maximum six strokes of the rotan if found guilty of gun trafficking.
He also faces a maximum punishment of seven years in jail, a fine of no more than RM10,000, or both, if convicted of being in possession of ammunition.
