Up to CAAM to further probe Elmina air crash, says Loke

The transport minister says if the aircraft operator broke the law, then action needs to be taken.

Transport minister Loke Siew Fook says it will be up to the Civil Aviation Authority of Malaysia (CAAM) to further investigate a 2023 plane crash that killed eight onboard following the findings of investigators.

Loke said when it comes to enforcement, it is up to CAAM to probe whether aircraft operator Jet Valet Sdn Bhd adhered to the regulations.

“If they broke the law, then action needs to be taken,” he said in a press conference today.

Loke was asked to comment on why Jet Valet was not licensed to operate aircraft, despite CAAM saying last year that the company was licensed.

Last week, the Air Accident Investigation Bureau (AAIB) said the primary cause of the 2023 plane crash near Bandar Elmina, Shah Alam, was the inadvertent extension of the lift dump spoilers.

“This action led to a sudden loss of lift, resulting in catastrophic loss of control and the subsequent crash,” AAIB said in its final report on the crash, adding that it believed the co-pilot made the fatal error.

Loke also said he could not provide an answer as to why the two pilots were in the wrong seats, adding that the ministry was only made aware of this when the report came out.

“But it is a breach in procedure, (however) now that the report is out, CAAM will make any necessary improvement,” he said, adding that AAIB’s report had highlighted loopholes concerning foreign-registered aircraft.

Last week, CAAM CEO Norazman Mahmud said new regulations on the operation of foreign-registered aircraft in Malaysia are expected to be released by year end.

He said the review of the rules was in line with safety recommendations provided by AAIB, particularly after the Elmina crash last year which also killed two road users.

The review aims to empower CAAM with improved oversight capabilities regarding foreign-registered aircraft operating within Malaysia.

On Aug 17, 2023, a Beechcraft Model 390 jet en route to Subang airport crashed near Bandar Elmina in Shah Alam. Pahang executive councillor Johari Harun was among those killed.
