In the application filed last week, Daim claimed that the MACC notice requiring him to declare his assets was founded on the report.

He added that the report was not included with the trial documents served on the defence by the prosecution.

“My lawyers wrote to the AGC (Attorney-General’s Chambers) requesting a copy of the complaint but received no response,” Daim said in an affidavit filed in support of his application.

Daim said the report “may be favourable to his defence” and that the prosecution was obliged to furnish him with a copy.

Asked by judge Azura Alwi whether the report exists, deputy public prosecutor Wan Shaharuddin Wan Ladin acknowledged that it did. However, he said the prosecution did not intend to rely on the document at trial.

The sessions court fixed Aug 27 to hear Daim’s application.

Earlier this year, Daim pleaded not guilty to a charge under Section 36(2) of the MACC Act 2009 of failing to comply with the terms of an asset declaration notice issued by the anti-graft agency.

He is accused of failing to declare his ownership in 38 companies, 19 plots of land in Selangor, Negeri Sembilan, Pahang, Kedah and Kuala Lumpur, as well as six properties.

Daim is also accused of failing to declare his ownership of Amanah Saham Nasional Bhd and Amanah Saham Nasional accounts, as well as seven luxury vehicles.

In a separate charge, his wife Naimah Khalid is accused under the same provision of failing to declare her ownership of various companies, several plots of land and two vehicles.
