
Solicitors Abhilaash Subramaniam & Co filed the notice of appeal in the High Court here yesterday.
Lawyer Shahrul Fazli Kamarulzaman, a member in Zahid’s legal team, told FMT a copy of the notice was served on them this morning.
A similar notice was also served on the Attorney-General’s Chambers.
Justice Amarjeet Singh is now expected to prepare the grounds of judgment for inclusion in the record of appeal.
On June 23, Amarjeet also dismissed the Bar’s application to refer several legal questions on Zahid’s case to the Federal Court.
He said the subject matter of the case was not amenable to judicial review as the AG has no duty to furnish the Bar with documents pertaining to investigations into the case.
On Sept 4 last year, Zahid was granted a discharge not amounting to an acquittal (DNAA) by Justice Collin Lawrence Sequerah in respect of 47 charges of corruption, money laundering and criminal breach of trust.
The AG had sought the DNAA premised on representations made by Zahid’s defence team to the prosecution following claims the Malaysian Anti-Corruption Commission was still investigating developments in the case.
In the application filed last year, the Bar had sought leave to quash the AG’s decision to secure the DNAA, claiming it was unreasonable and tainted with irrationality.
The Bar also wanted the court to compel the AG to disclose all information it had relied on and the basis of his decision to seek the conditional discharge.
