AG objects to Bersatu member’s bid to lift TikTok restrictions

The attorney-general says Naim Brundage should have appealed to MCMC’s appeal tribunal, and not come to court.

Bersatu’s Naim Brundage wants the High Court to lift ‘restrictions’ imposed by the government on his two TikTok accounts, saying they infringe his right to free speech.

The attorney-general (AG) has indicated to the High Court that he intends to object to a Bersatu Youth member’s application to lift “restrictions” imposed by the government on his TikTok accounts.

Naim Brundage is seeking leave to commence judicial review proceedings to challenge restrictions imposed on his two accounts.

He says the restrictions infringe his right to free speech, as he frequently posts videos commenting on political and economic issues.

Federal counsel Ainna Sherina Saipolamin, representing the AG, said Naim should have filed an appeal to the Malaysian Communications and Multimedia Commission’s (MCMC) appeal tribunal seeking that the restrictions be reviewed.

She added that communications minister Fahmi Fadzil should not have been named as co-respondent because he was not involved in the decision to impose restrictions.

Justice Ahmad Kamal Shahid said he will hear the leave application on Oct 23.

Lawyer Zaid Malek appeared for Naim.

Naim said MCMC wrote to him to inform him that his two TikTok accounts had been subjected to certain restrictions.

However, he said he was not informed of the reasons for the restrictions and was not given the right to be heard before the restrictions were imposed.
