
Lo filed the lawsuit in July 2021 in response to two articles published by Bernama, titled “Jason Lo charged with trespassing, injecting drugs into body” and “Court charges singer Jason Lo & colleague with CBT of RM200,000”.
Justice Mariana Yahya, who chaired a three-man bench, held that the High Court had not erred in its decision to dismiss Lo’s claim.
“The plaintiff’s counsel submitted that the allegedly defamatory words (in both articles) should be read in ‘isolation’ and not in entirety.
“We do not agree. The Federal Court previously held (and set as precedent) that while some parts were defamatory and some others were not, the claimant could not ‘pick and choose’ parts of the articles (that were deemed defamatory),” she said.
The other judges who presided over the case were Justices Nazlan Ghazali and Azman Abdullah.
The panel ordered Lo to pay Bernama RM13,000 in costs.
Last year, the High Court dismissed Lo’s lawsuit against Bernama, holding that there was no malice by the news agency in publishing the two articles.
The court also held that readers who read the entire text would recognise that Lo had only been charged but had not yet been proven to have committed the crime, and that he was released on bail.
Lo was represented by lawyer Choo Dee Wei while Adam Luqman Amdan appeared for Bernama.
