Former J-Kom officer fails to obtain injunction against Chegubard

The Kuala Lumpur High Court also dismisses application to delete Facebook posts on controversial video.

The Kuala Lumpur High Court has turned down former community communications department (J-Kom) assistant officer Abdul Wahab Abdul Kadir Jilani’s bid for an injunction to stop Badrul Hisham Shaharin, also known as Chegubard, from making statements about a viral video.

Judicial commissioner Roz Mawar Rozain also dismissed Wahab’s application for a court order to have Badrul delete his Facebook posts about the video, Utusan Malaysia reported.

Roz ruled that there was no real risk of Badrul repeating the alleged defamatory statements.

“The plaintiff (Wahab) failed to comply with the strict requirements under Order 29 Rule 1(2A) of the Rules of Court 2012,” she was quoted as saying.

“Furthermore, the plaintiff did not show that the statement was defamatory before this court even considers the defence raised by the defendant (Badrul).”

Roz ordered Wahab to pay RM10,000 in costs to Badrul.

The court also set June 4 for Badrul to file his defence against Wahab’s claims in his defamation suit, with Wahab required to file his reply by June 18.

The trial is scheduled for Sept 2, 3 and 4 next year, with further case management on July 3.

Earlier this year, Wahab filed a defamation suit against Badrul for implying that he is a homosexual.

He alleged that Badrul uploaded two defamatory Facebook posts in November last year implying that he was involved in homosexual activities and was not a good Muslim.

That same month, a three-minute recording showing a video call between a man allegedly resembling former J-Kom director-general Agus Yusoff and Wahab went viral on social media.

Agus, who claimed the video clip was edited, had also lodged a police report.

In December, Wahab, who is also the Hulu Langat PKR Youth vice-chairman, claimed that he had been sexually harassed by Agus.
