
Judge Zulqarnain Hassan said Dr Ranjeet Singh had proven his case against the government on the balance of probabilities.
“The defendants have failed to safeguard the plaintiff’s rights under the Federal Constitution,” he said in his ruling delivered to the parties via email.
Ranjeet was also awarded RM13,000 in costs.
In his statement of claim filed on June 21, 2023, Ranjeet said he was sleeping at 1am on Aug 12, 2021, when a group of policemen raided his home in Green Park Residence before arresting him.
He said that during the arrest, he was subjected to inhumane and oppressive behaviour.
He said the policemen failed to inform him of the grounds of arrest and did not comply with Section 23 of the Criminal Procedure Code as there was no reasonable suspicion for them to conduct the raid and arrest him.
Ranjeet claimed he suffered from post-traumatic stress disorder after the incident.
He had named the investigating officer, the raiding officer, the government and the inspector-general of police as defendants.
Ranjeet had asked for special damages, general damages, and exemplary and aggravated damages. He also sought a declaration that the arrest was unlawful and unconstitutional.
Counsel VR Satchitanandan, S Preakas and Chan Hoo Yan represented Ranjeet while senior federal counsel Afiq Nazrin Zaharinan acted for the government.
