Man jailed 20 years for raping daughter over 8 years

The man had caused psychological trauma to his daughter, who also gave birth to a child last year, says judge.

SEREMBAN:
A man was sentenced to 20 years in prison and ordered to be given five lashes of the rotan by the sessions court here today after he pleaded guilty to raping his daughter from the age of 12 to 20.

Judge Kamil Nizam, when sentencing the 44-year-old man, said this was a serious crime as the accused’s actions had traumatised his daughter and left her with severe psychological scars.

“You as a father were entrusted to take care of your children but you have done the opposite.

“The victim only filed a complaint after her parents were arrested by the police for another case. The victim must have felt unsafe while staying at home during that period,” he said.

The man was accused of committing incest with his then 18-year-old daughter at a village in Port Dickson on Nov 2, 2022.

In her police report, the victim said she was raped by the accused from the age of 12 until April 21 this year.

The teenager never reported the matter to anyone. After her parents were arrested in a narcotics case, she came forward to file a police report on May 1.

The teenager became pregnant in December 2022 and gave birth on Aug 17, 2023 at a hospital.

Her parents handed over the child to another person without her knowledge.

Earlier, the father of four, who was not represented, appealed for a lighter sentence as he was taking care of a young child and his sick wife.

Deputy public prosecutor M Kalaivaanan requested a long prison sentence as well as whipping, due to the severity of the crime.

Meanwhile, in a different sessions court, the accused and his 45-year-old wife were also charged for possession of yaba pills weighing 32.8g.

They were accused of committing the offence at the same place in Port Dickson at 2.30am on April 28, 2024.

The man pleaded guilty to the charge but his wife pleaded not guilty before judge Meor Sulaiman Ahmad Tarmizi.

The court set July 4 for the next mention.
