
In a ruling last week, Judicial Commissioner Suriyati Hasimah Hashim also ordered that the RM7,000 fine paid by Liaw Zhi Foh be returned to him.
The prosecution is appealing the High Court’s decision.
Deputy public prosecutor Sharifah Maleeha Syed Hussin appeared for the prosecution.
Lawyer JS Naicker represented Liaw, who had taken a motor vehicle insurance policy from India International Insurance, Singapore.
Naicker said the revision was filed two months ago as the guilty plea for the offence under Section 43(1) of the Road Transport Act 1987 was predicated on a mistake arising from discrepancies contained in the charge sheet.
The car driven by Liaw was involved in an accident with S Shanmuganathan’s motorcycle at the Tuas second link, which connects Singapore and Johor, at about 9pm on March 13, 2019.
The accident was said to have happened at KM1.4 of the stretch while the charge sheet stated that the collision occurred at KM0.4.
Liaw, who was unrepresented at the hearing, pleaded guilty.
Shanmuganathan then launched a negligence suit against Liaw in the Johor Bahru sessions court, claiming damages.
At trial in June last year, traffic investigating officer W Kiragaletchumi told sessions court judge Salawati Djambari that the charge sheet contained errors.
