MTUC drops court appeal, to hold fresh election

The Malaysian Trades Union Congress has decided not to proceed with an appeal against a court ruling that declared its triennial delegates’ conference in 2022 null and void.

In a statement, MTUC secretary-general Kamarul Baharin Mansor said it would drop the matter which is pending in the Court of Appeal.

He added that the MTUC general council had unanimously made the decision in a general assembly on Sunday.

“The decision was the will of the members who want to see MTUC focus on labour issues.

“A meeting to elect new officers will be held once an order is received from the Court of Appeal on the withdrawal of the case,” he said.

According to Kamarul, the Registrar of Societies had previously informed MTUC that its leadership elected in 2020 could continue their duties until a new election was held.

Last August, the High Court in Shah Alam declared the MTUC triennial delegates’ conference null and void for violation of several provisions in its constitution.

However, one month later, judicial commissioner Choong Yeow Choy stayed the ruling in the same court. He said there were special circumstances that warranted a suspension of the Aug 11, 2023 ruling pending the disposal of the union’s appeal to the Court of Appeal.
