
Justice Vazeer Alam Mydin Meera, who chaired a three-member bench, ordered Ishak Mat Nawi’s jail sentence to take effect from Dec 12, 2021, when he was arrested.
A magistrate had imposed the 70-month jail term and a fine of RM20,000, in default 12 months jail, after he pleaded guilty on Sept 19, 2022.
The bench maintained the RM20,000 fine, but reduced the 12 months to three if the fine was not paid.
“The appeal against sentence is allowed and the jail terms are reduced,” said Vazeer.
The other judges on the panel were Justices Ahmad Zaidi Ibrahim and SM Komathy Suppiah.
Ishak, 54, has been in jail since the magistrate’s verdict but has also not paid the fine.
He was accused of killing Yazid Ab Aziz, 39, at Km59 Jalan Kuala Lumpur-Kuala Lipis in Ulu Selangor at 5.45pm on Dec 12, 2021.
The charge was framed under Section 41(1) of the Road Transport Act 1987, which carries a jail term of up to 10 years and a maximum fine of RM50,000 upon conviction.
Ishak’s appeal to the High Court against the sentence was dismissed.
Lawyer Izleen Ismail appeared for Ishak while deputy public prosecutor Aida Khairuleen Azli represented the prosecution.
