AGC seeks to reinstate murder charge against ex-IT consultant in road rage case

The High Court had found Yew Wei Liang guilty of a lesser charge of culpable homicide not amounting to murder for causing the death of bank manager Syed Danial Syed Syakir.

The Attorney-General’s Chambers (AGC) is seeking to reinstate the murder charge against a former IT consultant found guilty of causing the death of a bank manager in a 2019 road rage incident.

A notice issued by deputy public prosecutor Dusuki Mokhtar said the AGC is appealing the Shah Alam High Court’s decision to convict Yew Wei Liang of a lesser charge of culpable homicide not amounting to murder under Section 304(a) of the Penal Code.

Yew was initially charged with murder under Section 302 of the Penal Code after repeatedly running into Syed Danial Syed Syakir on the North-South Expressway near Bandar Baru Bangi on Aug 10, 2019, resulting in his death at the scene.

However, on Dec 7, 2023, Justice Julia Ibrahim found him guilty of the lesser charge and sentenced him to 16 years jail from the date of his arrest on Aug 10, 2019.

Sentencing discretion for murder and drug trafficking was given to judges through amendments to several laws that took effect last July.

For murder, judges may impose a jail term of between 30 years and 40 years, while male offenders below 50 years of age could be flogged a minimum of 12 times.

Yew has filed an appeal to set aside his conviction and sentence.
