Printer wants PAS, Harakah’s appeal from RM656,000 judgment struck out

KUALA LUMPUR:
The printer of Harakah, the mouthpiece of PAS, has applied to strike out the party’s appeal to the High Court against summary judgment for RM656,233.69 handed down over unpaid printing fees.

In its application, NAJ Press Resources Sdn Bhd said PAS’s appeal is defective and served on them out of time.

They said that under the law, the notice of appeal must be filed and served within 14 days of the judgment issued by the sessions court.

The lower court entered summary judgment on Dec 5, 2023.

NAJ claims they were only served with a copy of the notice on Dec 28 – nine days out of time.

The printer had secured judgment in the sessions court against PAS and Harakah on the basis that they had acknowledged the debt owed in correspondence exchanged between them.

The sessions court also noted that part-payment had been made on the debt on Oct 31, 2017.

It was reported in 2019 that NAJ had issued a letter to PAS and Harakah demanding payment of RM3,053,204.59 in unpaid printing fees.

At the time, PAS’s secretary-general, Takiyuddin Hassan, denied the party was attempting to avoid paying.

The High Court has fixed April 4 to hear NAJ’s striking-out application.
