
Human rights group Suara Rakyat Malaysia (Suaram) said the court made the decision after hearing a habeas corpus application filed on the politician’s behalf.
Suaram executive director Sevan Doraisamy also urged the immigration department to comply with the court order and stop any plans to deport the politician.
Suaram said deporting the man would put him at risk of torture and other human rights violations, contravening international law and Malaysia’s human rights obligations.
“As a member of the United Nations Human Rights Council, Malaysia must uphold its commitment to respect and protect refugees fleeing persecution, as well as refrain from forcibly returning them to a country where they may face harm,” he said in a statement today.
“Violating the fundamental principle of non-refoulement would cast doubt on the Madani government’s commitment to human rights.”
Sevan likewise urged the government to immediately and unconditionally release the political leader, who is a registered UNHCR refugee.
