Rosmah, the wife of former prime minister Najib Razak, is attempting to have the case dismissed.
This morning, her lawyer Firoz Hussein Ahmad Jamaluddin requested that the hearing be adjourned, telling Justice K Muniandy that his client had been given two days’ medical leave.
“Though this is not a criminal trial, we are applying for a postponement as this is a substantial criminal application,” he said.
Amer Hamzah Arshad, another member of Rosmah’s defence team, said she had to be present because her lawyers might need to take instructions from her in the course of submissions.
Deputy public prosecutor Ahmad Akram Gharib raised no objection to the adjournment.
He also told the court that the Malaysian Anti-Corruption Commission was still looking into Rosmah’s representations to the attorney-general’s chambers (AGC).
On Dec 13, Firoz informed Muniandy that fresh representations had been submitted, asking that the AGC withdraw all charges.
Muniandy fixed case management for March 1 to determine when submissions will be heard and to fix trial dates in the event that Rosmah’s application is dismissed.
Rosmah faces 12 charges of laundering a total of RM7.09 million, and a further five charges of failing to declare her income to the Inland Revenue Board, which accuses her of not filing her income tax returns between Dec 4, 2013 and June 8, 2017, as required under the Income Tax Act 1967.
Her trial began on Aug 24, and two prosecution witnesses have testified. However, it stalled on Sept 6 after she filed to have the case dismissed.
