First person charged with cyberstalking ordered to undergo psychiatric treatment

PETALING JAYA:
A former freelance designer, who became the first individual to be charged with the offence of cyberstalking today, has been ordered to undergo psychiatric treatment for a period of one month.

Safiq Rosli, 37, will be sent for evaluation to Hospital Bahagia in Ulu Kinta, Perak. The order was made in accordance with Section 342 of the Criminal Procedure Code following an application made by deputy public prosecutor Zilfinaz Abbas.

Safiq had earlier pleaded not guilty when the charge was read before magistrate Sasha Diana Sabtu at the Shah Alam magistrates’ court.

He is accused of repeatedly harassing Acacia Mardiana Daud, 31, a photographer, on Twitter, knowing that it was likely to cause fear to his victim.

According to the charge, Safiq is alleged to have committed the offence between July 15 and 21.

He was charged under Section 507A(1) of the Penal Code.

If convicted, he will be liable for up to three years’ imprisonment, a fine, or both.

The offence of cyberstalking was introduced by an amendment to the Penal Code which came into force on May 31 this year.

Earlier, Zilfinaz presented the court with a medical report issued by Hospital Kuala Lumpur, where he had been undergoing psychiatric treatment since July 17.

The court has set the case for mention on Sept 7 pending the evaluation.
