Egg importer insists on entering default judgment in suit against Azmin

It says the former senior minister was late in entering his appearance although the court papers were served on him last month.

An egg importer suing ex-minister Azmin Ali for defamation has applied to enter a default judgment against the former senior minister for being late in entering his appearance.

J&E Advance Tech Sdn Bhd’s lawyer Elyse Tan said the application was filed on Monday.

Tan said all court papers in the suit were served on Azmin last month.

Azmin, who was previously in former prime minister Muhyiddin Yassin’s Cabinet, was reported to have appointed law firm Sasha Lyna & Partners to act for him the day after he was served the papers.

“We are instructed to proceed with judgment in default against the defendant (Azmin) as the appearance was entered out of time,” said Tan.

She said Azmin’s lawyers would be objecting to the application.

High Court judicial commissioner Leong Wai Hong has fixed the suit for case management on July 14.

J&E Advance Tech filed a defamation suit against Azmin on April 14 for claiming that it had been awarded a contract to import eggs from India through direct negotiations.

The company claimed that Azmin’s remarks, allegedly made at a Perikatan Nasional ceramah in March, were defamatory and had implied that the company had been dishonest in its dealings.

It further alleged that the remarks were made in bad faith and to incite the public against it.

The company is seeking general, exemplary and aggravated damages from Azmin.
