Ng Hui Yee and husband, Khor Swee Boon, were jointly charged in the Ampang magistrates’ court on Jan 17 for allegedly murdering Cho Lim Fong.
The alleged crime was said to have taken place on Dec 29, 2022 in front of a restaurant along Jalan Pandan Indah 1/22.
Cho was reported to have died of his injuries after a package exploded in his car.
In allowing bail, judicial commissioner Julia Ibrahim said Ng had satisfied all legal requirements set out in Section 388 of Criminal Procedure Code.
Under the provision, a woman charged with a crime classified as a “non-bailable offence” can ask to be released on bail.
In its decision, the court cited as precedent the case of Samirah Muzaffar, widow of Cradle Fund CEO Nazrin Hassan, who was released on bail in 2019 after she was jointly charged with two others for his murder. They were acquitted of the charge last year.
“The facts in Samirah’s case and the accused here (Ng) are similar, where both are housewives and have young children,” said Julia.
Other conditions imposed by the court require Ng to surrender her passport to the court and to report to the police station nearest to her home every fortnight.
She is also required to remain indoors between 6pm and 8am every night.
Ng’s lawyer RSN Rayer told FMT that she has yet to post bail due to the high quantum imposed.
She is currently remanded at Kajang prison.
“We have filed an appeal against the quantum. During the hearing, the court did not invite the defence and prosecution to argue on the amount,” Rayer added.
Meanwhile, the lawyer said no bail application was filed for Khor.
