
Her lawyer, Geethan Ram Vincent, informed High Court judge K Muniandy today the representations were submitted on May 3 with the view to dropping the charges.
“We seek an adjournment for the AGC to consider the representations. I believe the prosecution has no objection,” he said.
The trial had been scheduled to begin today.
Deputy public prosecutor Ahmad Akram Gharib confirmed receiving the representations, but said he had yet to make an appointment with Attorney-General Idrus Harun.
“I was busy with other criminal trials. I have to do some research and prepare a report based on the facts and issues raised in the representations to my superiors.
“Due to the complexity of the matter, I urge this court to give us two months to decide on the representations,” he said.
Akram also said the prosecution was not ready to proceed with the trial today, when queried by Muniandy.
“No, because serious legal issues have been raised in the representations,” he said.
The judge allowed the postponement and vacated the trial dates scheduled for today, May 28, June 30, July 6, 7,27, 28 and 31, and Aug 1, 2 and 11.
He fixed Aug 24 for the trial to begin should the representations be rejected.
On March 23, the prosecution told Muniandy it intended to call 13 witnesses to testify against Rosmah, the wife of former prime minister Najib Razak.
Rosmah is facing 12 money laundering charges involving RM7,097,750 and five counts of failing to declare her income to the Inland Revenue Board (LHDN).
She is accused of committing the offences between Dec 4, 2013 and June 8, 2017.
She was charged with the offences in a sessions court here on Oct 4, 2018 before the matter was transferred to the High Court.
In a separate case, on Sept 1 last year, then High Court judge Zaini Mazlan convicted Rosmah of soliciting RM187.5 million from former Jepak Holdings Sdn Bhd managing director Saidi Abang Samsudin through her former aide, Rizal Mansor, as an inducement to help the company secure the Sarawak schools’ solar power project.
She was also convicted of receiving bribes amounting to RM5 million from Saidi, through Rizal, at Seri Perdana in Putrajaya on Dec 20, 2016, and another charge of receiving another RM1.5 million from Saidi at Jalan Langgak Duta on Sept 7, 2017.
Zaini sentenced her to 10-year jail terms for all three charges but ordered them to run concurrently.
The court said if Rosmah failed to pay the RM970 million fine, she will have to serve another 10 years in prison, after she completes her initial 10-year sentence.
The Court of Appeal will hear the appeal on July 11.
