Siti Bainun reappoints lawyer, hands over 218 exhibits

The founder of Rumah Bonda is making her defence to a charge of neglect and abuse of Bella, a teenage girl with Down syndrome.

Rumah Bonda founder Siti Bainun Ahd Razali, accused of child abuse of a teenage girl with Down syndrome, told the sessions court she had reappointed her lawyer, submitted some photos and videos of the girl, Bella, and a police report to the defence team.

Siti Bainun, 31, said other exhibits included screenshots of Facebook posts by the prosecution’s first witness, Zurianty Sudin, and a birthday party video of the prosecution’s fifth witness, Yasmin Nahar Mahmood, which was also handed over to her lawyer.

She said a total of 218 exhibits were handed over to the defence for marking after being printed and copied by herself.

The prosecution objected to portions of Siti Bainun’s witness statement which she read out before sessions judge Izralizam Sanusi.

Deputy public prosecutor Zilfinaz Abbas said several paragraphs in Siti Bainun’s witness statement should be expunged because they were prejudicial.

He said Siti Bainun had challenged the testimony of experts who were called as prosecution witnesses. “We argue that the defendant is not an expert to criticise the testimonies of our witnesses,” he said.

Siti Bainun’s counsel, Farhan Maaruf, urged the court to allow his client to read the full written statements as they were not prejudicial.

The judge later allowed Siti Bainun to read the fifth and sixth paragraphs to which the prosecution had objected.

At the proceedings today, Siti Bainun informed the court that she had re-appointed Farhan, who had previously withdrawn himself from representing her.

Siti Bainun was ordered to enter her defence against the charge last month, even without representation, after the court decided that the defence proceedings would go on so as not to disrupt the course of the case.

She was alleged to have committed the offence in a condominium unit in Wangsa Maju between February and June 2021.
