Tractor driver spared gallows on reduced drug charge

Court of Appeal told the Attorney-General's Chambers had accepted a representation by Ng Kim Foon to reduce the charge from trafficking to possession.

A tractor driver sentenced to death by the High Court saw his sentence reduced to 12 years’ jail today after the prosecution agreed to amend his charge from trafficking to possessing 225.3gm of cannabis five years ago.

A three-member Court of Appeal bench chaired by Justice Hanipah Farikullah also ordered Ng Kim Foon to be whipped 10 times, which is a mandatory requirement under the law.

Earlier, lawyer Naizatul Zamrina informed the bench her client had succeeded in his representation to the Attorney-General’s Chambers seeking a reduction of the charge from trafficking to possession.

Deputy public prosecutor K Mangai confirmed the matter.

Ng, 44, pleaded guilty to the amended charge.

Hanipah, who sat with Justices Supang Lian and Ahmad Nasfy Yasin, ordered the jail term to begin from Nov 2, 2018, the day Ng was arrested.

Naizatul, who was assisted by Wan Zaleha Abdul Wahab, proposed a jail term of between five and seven years as Ng is a first offender and has expressed remorse for his actions.

However, Mangai suggested that Ng should serve a jail term of 10 to 12 years, and urged the court to also consider the weight of the drugs.

On March 29, 2021, Ng was sentenced to death by the High Court for trafficking drugs at a club in South City Plaza in Seri Kembangan, Selangor, on Nov 2, 2018.
