Businessman jailed 3 years for traffic offence freed on bail

Adrian Khoo began his prison sentence on Aug 8 after he was found guilty of causing the death of a motorcyclist 10 years ago.

A three-member Court of Appeal bench has allowed businessman Adrian Khoo’s leave application to hear the merits of his appeal based on a revised question of law.

A businessman serving a 36-month sentence for a traffic offence committed 10 years ago has been freed pending the outcome of his appeal.

A three-member Court of Appeal bench chaired by Hadhariah Syed Ismail allowed Adrian Khoo, 28, a bail of RM8,000 today.

Hadhariah ordered Khoo, who has been in Kajang prison since Aug 8, to report to the nearest police station within the first week of every month until the disposal of his case.

The other judges on the panel were Nordin Hassan and See Mee Chun.

The bench also allowed Khoo’s leave application to hear the merit of his appeal based on a revised question of law.

The question, pursuant to section 182 of the Criminal Procedure Code for an offence under section 41(1) of the Road Transport Act, is on whether a maximum evaluation at the close of the defence case is the correct standard of proof, as opposed to beyond a reasonable doubt.

At the outset of the proceedings, Khoo’s lawyer, Guok Ngek Seong, had said the prosecution had agreed to the revised question to be argued during the appeal.

Guok said deputy public prosecutor How May Ling had no objection for bail to be given to Khoo.

On Aug 8, the Shah Alam High Court ordered Khoo to serve his 36-month sentence after dismissing his appeal against his conviction and sentence.

The magistrates’ court had earlier stayed his imprisonment term pending disposal of his initial appeal to the High Court.

Khoo has paid his fine of RM10,000.

He was charged with driving his car recklessly at a traffic light junction along Persiaran Bestari here at about 7am on Aug 29, 2012, resulting in the death of motorcyclist Shafiq Mahfok, 22.
