
Judge Ahmad Kamal Md Shahid fixed the hearing date after the court was told that the AGC, represented by senior federal counsel Shamsul Bolhassan, had filed a preliminary objection to Rosmah’s application for permission to commence judicial review proceedings.
The AGC contends that Rosmah’s application was filed out of time.
The court instructed Rosmah’s lawyers, Jagjit Singh and Akberdin Abdul Kader and the AGC to file all affidavits before July 28.
Kamal had earlier granted Sri Ram permission to participate in the proceedings as a putative respondent.
“You can file your reply to (Sri Ram’s) affidavit,” he told Rosmah’s lawyers.
Sri Ram filed an affidavit last week to oppose a fresh bid by Rosmah to disqualify him, adding that his appointment as ad hoc prosecutor was affirmed by the Federal Court on May 27.
Rosmah had claimed that Sri Ram’s appointment, made under Section 376(3) of the Criminal Procedure Code, was defective.
She alleged that the former Federal Court judge was only appointed by then attorney-general Tommy Thomas to handle prosecutions in 1MDB-related cases and not her corruption case.
Rosmah, the wife of former prime minister Najib Razak, sought a court order to set aside Sri Ram’s appointment and to suspend all proceedings in her corruption case.
Last year, Rosmah filed a similar application to remove Sri Ram from prosecuting her solar hybrid project case and to nullify her corruption case, but her application was dismissed by the courts.
Rosmah is facing three counts of corruption for allegedly soliciting RM187.5 million from former Jepak Holdings Sdn Bhd managing director Saidi Abang Samsudin through former aide Rizal Mansor, as an inducement to help the company secure a solar hybrid project for rural schools in Sarawak.
She is also accused of receiving bribes amounting to RM6.5 million from Saidi between 2016 and 2017.
Another High Court is set to rule on Rosmah’s corruption case on Sept 1.
