Court dismisses bid to stop MTUC triennial conference

The faction in the Malaysian Trades Union Congress (MTUC) led by Halim Mansor, who is claiming to be the rightful president, has failed to obtain an injunction to stop the congress’ triennial delegates conference (TDC) tomorrow.

In her ruling this afternoon, Shah Alam High Court judge Khadijah Idris dismissed the application with costs, thus paving the way for the two-day conference to go on as scheduled, with Prime Minister Ismail Sabri Yaakob set to open it.

Halim’s lawyer, Ashrul Ashri, said the judge cited the Rules of the Court 2012 which states that an ex parte injunction cannot be granted to prevent the meeting of any registered society.

MTUC secretary-general Kamarul Baharin Mansor said the conference will go ahead as scheduled.

Halim’s lawyers filed the affidavit on Tuesday claiming that the MTUC leadership had violated the congress’ constitution by not adhering to the requirements needed before calling for the conference.

Among others, he claimed that the conference should have been called only between October and December of the third year of any term, as stipulated in the congress’  constitution.
