Inquest into ex-Cradle Fund CEO’s death untenable, says lawyer

An inquest to determine the cause of former Cradle Fund CEO Nazrin Hassan’s death four years ago is untenable as a criminal trial has been concluded, a lawyer said.

SN Nair said the public prosecutor had framed charges, and the High Court had made its ruling.

“The court has gone through the evidence and as such, an inquest is untenable and inapplicable,” he told FMT.

Nair said this in response to remarks by Nazrin’s brother, Dr Abdul Aziz Che Hassan, on Tuesday that the family hoped the prosecution would file an appeal against the ruling. “If they do not do so, we will ask for an inquest to determine his cause of death,” he told reporters.

High Court judge Ab Karim Ab Rahman acquitted Samirah Muzaffar and two teenagers of the murder of her husband on grounds that the prosecution had failed to prove a prima facie case against them.

Samirah, 47, the teenagers, now aged 19 and 16, and an Indonesian maid, Eka Wahyu Lestari, who is at large, were charged with murdering Nazrin at their home in Mutiara Damansara on June 14, 2018.

The prosecution called 57 witnesses to testify, including Aziz and two pathologists – Dr Siew Sheue Feng and Dr Prashant Samberkar – who conducted two separate post-mortems on Nazrin’s remains.

Nair said an inquest could be held when the police were unable to ascertain the cause of death when a body was found.

“The brother’s comments to the media came about as he misunderstood the process of the law,” he said.

The prosecution has 14 days to file a notice of appeal to have the findings of the trial judge reviewed by the Court of Appeal.
