Adib’s dad withdraws contempt suit against Thomas

The legal firm representing the family says police should continue searching for those responsible for the firefighter's death in 2018.

The family of the late firefighter Adib Mohd Kassim has ended its legal action to commit former attorney-general Tommy Thomas for contempt of court over his remarks on the inquest’s proceedings.

The legal firm representing the family, Mohd Zubir Embong & Associates, said both the family and the Attorney-General’s Chambers (AGC) have withdrawn their appeals in court.

“The lawyers filed a notice in court on May 31 following an order by the family of the late Adib to withdraw the appeal. This was followed by a confirmation by the AGC that they have also withdrawn their application to the Federal Court,” the firm said in a statement today.

“The family of the late Adib considers that the process and proceedings of contempt of court against Thomas and the AGC have been resolved.”

It also said the decision to withdraw the family’s appeal did not mean the police should stop searching for those responsible for Adib’s death, noting that criminal investigations had no time limit.

The AGC previously filed an appeal in the Federal Court to challenge the Court of Appeal’s decision in February that the Shah Alam coroner’s court had jurisdiction to grant leave to institute contempt proceedings against Thomas.

Adib’s family had also appealed against a Shah Alam High Court ruling that Thomas had the right to appeal and to set aside the leave granted to the coroner’s court to initiate contempt proceedings against him.

Adib’s father, Mohd Kassim Abdul Hamid, had filed an ex parte application for a committal order against Thomas for allegedly insulting the court through the filing of an affidavit by the AGC on April 3, 2019, which indicated that Adib’s death was not due to injuries caused by someone.

Kassim also accused Thomas of committing contempt by issuing a media statement on May 28, 2019, while the inquest was under way.

Thomas was the attorney-general from June 2018 to February 2020.

On Sept 27, 2019, coroner Rofiah Mohamad had ruled that “more than two unidentified persons” had killed Adib, who died after succumbing to injuries he sustained after being sent to the scene of a riot outside the Sri Maha Mariamman temple in Subang Jaya.

Adib, 24, a member of the Subang Jaya fire and rescue department, was seriously injured in the riot on Nov 27, 2018 and died at the National Heart Institute on Dec 17 that year.
